CEDAR COVE COMMUNITY BEACH RESERVATION TERMS & CONDITIONS
Only a Cedar Cove resident may reserve use of the Cedar Cove Community Beach for a private event. Any applicant signing the Cedar Cove Community Beach Reservation Form must be at least 21 years of age and must be present at all times during said event. Any HOA dues and/or assessments against Lot must be paid.
No event shall adversely affect the enjoyment of the beach area for other Cedar Cove residents who are not invited to said event. Small gatherings are preferred, no more than 25 persons. Larger groups may be approved on a case by case basis.
All pets must be on a leash at all times. The owner must immediately clean up after their pet and then dispose of it properly in a trash can.
The Cedar Cove resident (User) that reserves the Cedar Cove Community Beach is responsible to clean up after the event. Users should include enough time to set-up, take down, and clean the area. The Cedar Cove Community Beach will not be available prior to the User’s scheduled start time and/or after the scheduled end time.
The User shall ensure that the event for which the Cedar Cove Community Beach is used is conducted in an orderly fashion without causing nuisance and in full compliance with the directives and requirements of the CCCA and with all state, county, and city laws, ordinances, and regulations. The User is responsible for all guests at all times.
A User may be limited on the number of times they may reserve the Cedar Cove Community Beach to allow equitable use for all residents of the Cedar Cove community.
The Cedar Cove Community Beach is not available for fundraising programs. There will be no sales of products or services and no collection of any kind of fees and admissions or donations. Charges for speaker fees are not allowed.
The Cedar Cove Community Beach is not available when, in the judgement of the CCCA, the use poses a threat to life, safety, or property, or if activities may disrupt or impede the normal operations of the Cedar Cove Community Beach for other Cedar Cove residents.
The Cedar Cove Community Beach is available for reservation every day from Sunrise to 10 PM. Users may reserve the Cedar Cove Community Beach for a maximum of 8 hours per day. The CCCA reserves the right to amend, alter and/or rescind the permitted time, use and location of the issued approved reservation due to COVID guidelines, construction, conservation and refurbishment projects and other issues. The User will be notified as soon as information becomes available.
There is no fee for use of the Cedar Cove Community Beach, but individuals or groups that cause damage are liable for the charges for repairs, replacements, and restoration of the Cedar Cove Community Beach. The CCCA also has the authority to collect reasonable attorney fees or court costs in its duties of enforcement.
The Cedar Cove Community Beach may not be used for activities in violation of any state, county, or city laws, ordinances, and regulations, or in any way that otherwise damages our property or our reputation. The premises may only be used for the purpose communicated to us in connection with the reservation. Should it, after the reservation has been approved, become known that the User has provided incorrect or misleading information regarding the event and the event is in conflict with our rules and regulations, the CCCA is entitled to cancel the event.
The CCCA has the right to cancel existing reservations and to refuse future reservations to Users who fail to abide by the Cedar Cove Community Beach rules and regulations. Any violations of rules, the User will lose the privilege of reserving the Cedar Cove Community Beach.
Application for the use of the Cedar Cove Community Beach must be made at least 7 days in advance and all reservations must be approved in writing by the CCCA prior to use.
Waiver:
User knows, understands and acknowledges the risks and hazards associated with using the Cedar Cove Community Beach and hereby assumes any and all risks and hazards associated therewith. User and the User’s invitees hereby irrevocably waives any and all claims against the CCCA for any bodily injury (including death), personal property loss or damage incurred as a result of using the Cedar Cove Community Beach and hereby irrevocably releases and discharges the CCCA, from any and all claims of liability arising out of or associated with the use of the Cedar Cove Community Beach.
Indemnification:
User and the User’s invitees shall indemnify and hold harmless the CCCA, from and against any and all liabilities, judgments, settlements, losses, costs, or charges (including attorney’s fees) incurred by the CCCA, as a result of any claim, demand, action, or suit relating to any bodily injury (including death), personal property loss or damage, or any other basis for action against the CCCA, caused by, arising out of, related to or associated with the use of the Cedar Cove Community Beach by the User or by the User’s invitees.
Property Damage:
User shall assume responsibility and pay the CCCA for any and all physical loss or damage to the Property (including the cost to repair or replace the property) caused by, arising out of, relating to or associated with the use of the Cedar Cove Community Beach by the User or by the User’s invitees.
DO NOT DISTRIBUTE THE CODE. We are trying to control the issues associated with the Community Beach. Please do not give the code to friends or relatives. You must personally verify each guest prior to unlocking the gate for them. Do not leave the gate unlocked to allow your guests in.
